AI Copyright: Will I Own the Copyright to Posts Created with BrandWell?

A software agreement about your output and copyright protection for that output are different questions. Using BrandWell does not by itself establish that every AI-generated passage is protected by copyright in every jurisdiction.

The U.S. Copyright Office’s January 2025 report distinguishes human-authored expression from material generated by AI. Its announcement explains that using AI assistance does not automatically prevent protection for a larger work, but prompts alone do not supply the human authorship required for copyright in the generated output. What to check in your BrandWell agreement

Review the current agreement that applies to your account and intended use. Look for provisions about inputs, outputs, permitted use, third-party material, and responsibilities. If a provision is unclear, obtain clarification before making a promise to a client.

A contractual permission to use output should not be described as a guarantee that the law recognizes copyright in every part of it. Likewise, a contractual allocation of rights does not eliminate the need to check source material, licenses, and other applicable restrictions.

Build a reviewable record of the work

Keep the brief, sources, drafts, and editorial decisions relevant to a project. Record where people contributed original expression, selected or arranged material, revised the argument, or supplied examples. This helps an editor or adviser understand how the finished piece was made.

Do not add token edits simply to make a legal claim. Focus on producing useful, accurate work and obtain qualified advice when ownership or registration is important to a contract.

Check source material and similarity

AI-generated text can still need attribution or revision. Review quotations, distinctive passages, images, statistics, and claims. A similarity scan can help identify material to inspect, but a clean result is not a legal clearance.

When using customer materials or licensed sources, confirm that your intended processing and publication are permitted. Keep the source and usage information with the project so the reviewer can check it.

  • What does the current agreement permit you to use and deliver?
  • Which parts of the work reflect human creative contributions?
  • What third-party sources, images, quotations, or licenses are involved?
  • What representations does the client contract require?
  • Does the intended jurisdiction or use require qualified legal advice?

Common questions

Does AI assistance make a whole article unprotectable?

The U.S. Copyright Office distinguishes AI-generated material from human contributions. The analysis depends on the work. Consult the linked official guidance and qualified advice for your circumstances.

Can a detector prove copyright ownership?

A detector score is not a record of who created the protected expression or what rights were granted. Use the actual creation history, source records, agreements, and applicable legal guidance.

Can BrandWell promise ownership in every country?
